This Privacy Policy describes how this website (the “Site”) operated by Scentille LLC, a New York limited liability company (“Scentille” or “us” or “we” or “our”) collects, uses, and discloses your Personal Information when you visit or make a purchase from the Site. Any individual or agent or representative on behalf of any business entity (“you” or “your”) who accesses this site or purchases any goods or uses the Service from this site shall be deemed to have accepted this Privacy Policy.  We reserve the right to revise, change, amend, alter or modify (hereinafter, "Update") this Privacy Policy and its other policies and agreements at any time and in any manner. You are responsible for periodically checking for any Updates of this Privacy Policy by re-visiting the Site and using the "refresh" button on your  browser. Any Updates supersede any prior versions immediately upon posting on the Site. Using the Site after any such Update or changes to the Privacy Policy shall constitute consent to changed terms or practices.

9. PROTECTION OF CHILDREN

 This Site is intended for an adult audience only, and children under the age of eighteen (18) are not eligible to use this Site.  Entry into this Site requires age verification.  We require all users to be at least eighteen (18) years old to use any area of the Site. You represent that you are at least eighteen (18) years old. We ask that minors under the age of eighteen (18) do no submit any personal information to us. 

 10. SECURITY PROECDURES

 We undertake reasonable efforts to operate secure data networks which are protected by industry standard firewall and password protection systems. Scentille undertakes reasonable efforts to review its security and privacy policies on a periodic basis and it may adjust and change the systems as necessary. Notwithstanding the above, and although Scentille is ever diligent in its security pursuits, it cannot guarantee the success of its efforts.

 11. ATTORNEY'S FEES

You promise to indemnify us for any attorneys' fees and costs incurred by us to enforce this Privacy Policy, including costs associated with any collection efforts such as attorneys’ fees incurred to collect attorneys’ fees and costs that we are entitled to recover as a prevailing party in any action. If we obtain a judgment against you pursuant to this Privacy Policy, prejudgment and post-judgment interest shall accrue thereon at the maximum amount allowed by applicable law. 


 12. GOVERNING LAW; VENUE; DISPUTE RESOLUTION

This Privacy Policy shall be governed by and interpreted in accordance with the laws of the state of New York without regard to the conflict of law rules of the state of New York, United States of America. You agree and acknowledge that any claim or dispute arising from or related to this Privacy Policy or the relationship of the parties in any respect thereto shall first be submitted to mediation, and that engaging in such mediation is a condition precedent to bringing any claim against Scentille arising from or related to this Privacy Policy. Such mediation may be initiated by either party by providing a written demand for mediation to the other party and shall be conducted in New York County, New York, United States of America in accordance with the then current Commercial Mediation Procedures of the American Arbitration Association ("AAA"). If settlement is not reached within sixty (60) calendar days after delivery of a written demand for mediation, such claim or dispute shall be submitted to and be settled by final and binding arbitration in New York County, New York, United States of America in accordance with the then current Commercial Arbitration Rules of the American Arbitration Association. If arbitration is not available, or in the event of litigation to enforce arbitration or settlement between the parties to this agreement, you agree that sole jurisdiction and venue shall be in the state and federal courts located in New York County, New York, United States of America and you waive any defense of jurisdiction and/or venue that may now or hereafter exist. You further agree that any mediation or arbitration may be conducted through audio and video conferences with any software or electronic platform offered or permitted by AAA.


 13. ENTIRE AGREEMENT; SEVERABILITY

You understand that this is the entire contract between you and Scentille, and that it cannot be modified or changed in any way by the representations or statements of Scentille or its employees or agents or by me. This Privacy Policy supersedes any and all previous oral or written promises or agreements. You understand and agree that this Privacy Policy is intended to be as broad and inclusive as permitted by the laws of the state of New York, United States of America and that if any portion thereof is held invalid, it is agreed that the remainder of the Privacy Policy will remain in effect and will continue in full legal force and effect.

 14. EFFECT OF AGREEMENT

You have read the above and fully understand the provisions of this Privacy Policy and you have either consulted an attorney regarding the Privacy Policy or have elected not to do so. You agree that you are giving up your important legal rights voluntarily, freely, under no threat of duress, without inducement, promise or guarantee being communicated to you. You have had reasonable and sufficient opportunity to read and understand this entire Privacy Policy or you will remain responsible to check and understand any amended provisions for which you will not receive any advance notice. You unconditionally agree to the full terms, statements, warranties, notices, representations, waivers and releases contained in this Privacy Policy on behalf of yourself or anyone else in your representative capacity, as applicable. All references to Privacy Policy herein shall mean the most recent and amended version of the Privacy Policy.

 15. DO NOT TRACK

Please note that because there is no consistent industry understanding of how to respond to “Do Not Track” signals, we do not alter our data collection and usage practices when we detect such a signal from your browser.

We may update this Privacy Policy from time to time in order to reflect, for example, changes to our practices or for other operational, legal, or regulatory reasons.
